Abstract

ABSTRACT

The development of artificial intelligence (AI) has created legal gaps in determining rights attribution for AI-generated works, while also raising issues concerning the use of Intellectual Property (IP) as a financing asset and the effectiveness of enforcement in cross-border digital environments. These gaps are important to address because fragmented IP regulations may undermine certainty of ownership, economic value, access to financing, and rights protection in the digital economy. This study aims to analyze the legal status of AI-generated works, examine IP as a financing asset, and reconstruct an integrated IP legal framework to support cross-border enforcement. This study employs normative juridical research using statutory, conceptual, comparative, and legal gap analysis approaches to Indonesian regulations and selected international legal regimes. The findings indicate that rights attribution for AI-generated works should be based on the extent of human creative contribution, while the use of IP as collateral requires certainty of ownership, valuation, economic information, and enforcement mechanisms. Digital IP enforcement also requires interoperable cross-jurisdictional dispute resolution mechanisms. The study proposes the IDICE and DICE-ACE frameworks as conceptual reconstructions integrating IP protection, valuation, financing, and enforcement within the digital ecosystem. These frameworks can support the development of adaptive IP policies responsive to AI and the digital economy.

ABSTRAK

Perkembangan kecerdasan buatan (AI) menimbulkan kesenjangan hukum dalam menentukan atribusi hak atas karya yang dihasilkan AI, sekaligus menghadirkan persoalan mengenai pemanfaatan Hak Kekayaan Intelektual (HKI) sebagai aset pembiayaan dan efektivitas penegakannya dalam lingkungan digital lintas batas. Kesenjangan tersebut penting dikaji karena hukum HKI yang masih terfragmentasi berpotensi menghambat kepastian kepemilikan, nilai ekonomi, akses pembiayaan, dan perlindungan hak di ekonomi digital. Penelitian ini bertujuan menganalisis status hukum karya AI, mengkaji HKI sebagai aset pembiayaan, serta merekonstruksi hukum HKI yang terintegrasi untuk mendukung penegakan lintas batas. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, komparatif, dan analisis kesenjangan hukum terhadap regulasi Indonesia serta beberapa rezim hukum internasional. Hasil penelitian menunjukkan bahwa atribusi hak atas karya AI perlu didasarkan pada intensitas kontribusi kreatif manusia, sedangkan pemanfaatan HKI sebagai agunan memerlukan kepastian kepemilikan, valuasi, informasi ekonomi, dan mekanisme eksekusi. Penegakan HKI digital juga membutuhkan interoperabilitas mekanisme penyelesaian sengketa lintas yurisdiksi. Penelitian menghasilkan kerangka IDICE dan DICE-ACE sebagai rekonstruksi konseptual untuk mengintegrasikan perlindungan, valuasi, pembiayaan, dan penegakan HKI dalam ekosistem digital. Kerangka tersebut dapat menjadi dasar pengembangan kebijakan HKI yang adaptif terhadap AI dan ekonomi digital.
